Applicant is seeking regular bail in Crime No. 240/2016 registered with Ghodegaon Police Station, Tal. Ambegaon, Dist. Pune for offence punishable under Sections 363, 366, 376 (2) (n), 506 of the Indian Penal Code and under Sections 4, 8 & 12 of the Protection of Children from Sexual Offences Act, 2012. Applicant is arrested on 10/07/2018.

All the other accused persons are released on bail. Perused the

2 32.21.19 ba.doc statement of the victim recorded under section 161 & 164 of the Code of Criminal Procedure, 1973.

Complaint came to be lodged on 29/11/2016 whereas accused alongwith victim girl was traced sometime in June 2018. Investigation carried out till date reveals that applicant was in relation with the victim girl and they stayed together for more than one and half year after the alleged claim of prosecution that she was abducted.

Admittedly no issue is born out of the alleged relationship. In the aforesaid background, in my opinin, applicant deserves to be released on bail. Hence, following order: (I) Applicant be released on bail in Crime No. 240/2016 registered with Ghodegaon Police Station, Tal. Ambegaon, Dist. Pune on furnishing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount.

3 32.21.19 ba.doc (II) Applicant shall not influence the witnesses or tamper with evidence.

(III) Applicant shall not enter the jurisdiction of the Ghodegaon Police Station but for attending the Court proceedings till the conclusion of the trial. Application stands disposed of.
