The Petitioner is a Defendant in the S.C. Suit No.1524 of 2012 pending before the Bombay City Civil Court, at Dindoshi, Mumbai.

The learned counsel submits that Chamber Summons has been filed by the Petitioner. He has filed Notice of Motion bearing No. 1715 of 2014. It is submitted that Court is seized of proceedings and it is likely to hear the Chamber Summons and pass orders on the same. Petitioner's request is that direction be issued to the Court to take up this Notice of Motion first.

Apropos, it is a fact, the learned Court is seized of the proceedings. It is left to the discretion of the Court to deal with these pending Chamber Summons and Notice of Motion at the appropriate time. At this stage, as regards issue of jurisdiction, no direction can be issued as prayed today.
