In crime No.306/2018 for offence punishable under section 420, 409, 468, 471 and 201 of the Indian Penal Code registered with Khed police station, District Ratnagiri, the applicant is seeking regular bail.

After arrest on December 7, 2018 the applicant, an

2 ba26-199 corrected order.doc academician was subjected to custodial interrogation. The allegations against the applicant is that the applicant mismanaged the funds of an educational institution in the capacity of In-charge Principal. Learned counsel for the applicant has invited attention of this Court to the detailed reply tendered by the applicant to the charges levelled against the applicant in a departmental inquiry proceedings. The gist of the reply demonstrates that the applicant has made substantial payment of amounts through either cheques / demand draft or Online.

Apart from above, the fact remains that the applicant has already been subjected to custodial interrogation. There are no criminal antecedents.

Learned APP, on instructions, submits that the chargesheet is expected to be filed within a period of six weeks from today.

That being so, the applicant, in my opinion, deserves to be released on bail. Hence the order :- (i) The applicant be released on bail in crime No.306/2017 for

3 ba26-199 corrected order.doc offence punishable under section 420, 409, 468, 471 and 201 of the Indian Penal Code registered with Khed police station, District Ratnagiri upon furnishing P.R. bond of Rs.15,000/- with one surety in the like amount; (ii) The applicant shall not influence the witnesses or tamper with the prosecution evidence ;

(iii) The applicant shall attend the investigating officer as and when directed.
