By this First Appeal, the Appellant is challenging the Judgment and decree dated 23.03.2015 passed by the Civil Judge, Senior Division, Dadra and Nagar Haveri at Silvassa in Special Civil Suit No. 46 of 2004. 3.

Considering the submission made by learned Counsel for the Appellant and impugned Judgment, I am satisfied that the Appellant has made out case for following order :

(i) Admit.

(ii) Printing dispensed with.

(iii)Registry is directed to call R & P immediately. (iv) Appellant to file private paper book within one year from today, failing which First Appeal shall stand dismissed without referring back to the Court.
