Heard the learned counsel for the Petitioner and the learned APP for the State . Today the Hon'ble Justice Mridula Bhatkar is not available for judicial work.

These petitions are filed by the Petitioner seeking cancellation of non-bailable warrant against the present Petitioner issued by the Additional Sessions Judge, Mumbai on 11th December, 2018.

The learned counsel for the Petitioner submits that in fact, the Petitioner is on bail. He had not disputed his identity. That on 11th December, 2018, after the completion of the in-camera proceedings, the matter was called out. The Petitioner had been to call his lawyer, who was busy before another Court and in the

601-602 WP 50 of 2019 meanwhile, the non-bailable warrant was issued. The learned counsel submits that the scheduled date in Sessions Case Nos. 383 and 384 of 2007 is on 6th March, 2019. The Petitioner undertakes to remain present before the Court.

In view of this, the non-bailable warrant issued vide order dated 11th December, 2018 is hereby stayed till 5.00 p.m. of 6th March, 2019.
