IN THE HIGH COURT OF JUDICATURE AT BOMBAY CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 61 OF 2015 Devanand Baban Mohite.

State of Maharashtra & Others.
..Respondents.
None for the Petitioner.
Mr. J. P. Yagnik, APP for the State.
Coram : Ranjit More & G. S. Kulkarni, JJ.
Date : November 18, 2016.
P. C. :
1.
None appears for the Petitioner. Heard learned APP for the State. This petition is filed seeking directions to the Respondents to lodge an FIR against the offender police officers of Kolsewadi Police Station, Kalyan on the basis of complaint dated 2nd April 2014.
2.
Mr. Yagnik, learned APP submitted that the Petitioner is an accused in CR. No.I-412 of 2013 registered at Kolsewadi Police Station, Kalyan for the offence punishable under sections 353, 332, 341, 186 and 504 the Indian Penal Code, 1860. It seems that the Petitioner in order to save himself, has made allegations against the police officers. Be that as it may, the Petitioner's complaint referred to above discloses that the same was made by M/s. I. B. Singh & Associates, Advocates and patilsr 1 / 2
Consultants and not by the Petitioner personally. The Petitioner has not approached any of the police stations or has not resorted to the provisions of section 154 of the Code of Criminal Procedure, 1973. We are therefore not inclined to entertain this writ petition and the same is accordingly dismissed. 3.
Needless to state that the Petitioner is at liberty to approach the Commissioner of Police for redressal of his grievance or file private complaint, if he so desires. [G. S. KULKARNI, J.] [RANJIT MORE, J.] patilsr 2 / 2
