Civil Application is filed by the Applicant seeking condonation of delay, which the Counsel for the Applicant explained as per the revised computation is of 44 days, in filing the Family Court Appeal. The prime reason cited for the delay is that after the impugned judgment and decree of the Family Court, the husband was trying to negotiate settlement with the wife, an averment, which the wife has disputed. Whatever be the level or stage of such settlement proposals, the delay of 44 days cannot be fatal for the delay. Under such circumstances, delay is condoned.
