Learned Counsel appearing for the petitioner submits that Regular Civil Suit No. 355/2013 is filed before the Civil Judge, Senior Division, Panvel in respect of the subject property. The grievance of the Counsel is that during the intervening period some illegal unauthorised construction is being carried out in Survey No. 91 in the subject immovable property.

Without expressing any opinion on merits, we observe that the petitioner may resort to appropriate remedies as permissible in law as
