1] Learned counsel for the Applicant has approached this Court contending therein that while admitting the Appeal this Court had issued notice under Section 390 of the Criminal Procedure Code. It is however submitted that since the Applicant has changed his address in the year 2010, a notice could not be served and as such non-bailable warrant came to be issued. The Applicant has been accordingly arrested on 4th December 2017.

2] The Applicant is therefore directed to be released on bail in BGP.

Criminal Appeal No.748 of 2014 on the condition that he furnishes bail bond in the sum of Rs.15,000/- with one or more sureties in the like amount. The Application is disposed of.
