The applicants were apprehending arrest in CR No.178 of 2019 registered with Chembur Police Station for offence u/s.420 r/w 34 of Indian Penal Code. The applicant no.1 has expired on 20th January 2022.

Learned counsel for applicant no.2 and the complainant have submitted that parties have amicably settled the dispute. Consent terms are executed between applicant no.2 and complainant. Parties have preferred Writ Petition (Stamp) No.1123 of 2022 for quashing FIR No.178 of 2019 by consent on the ground of settlement. The consent terms dated 15th February 2022 are signed by applicant no.2 and original complainant and their respective advocates. In view of above, this application can be allowed.

ORDER

(i) Anticipatory Bail Application is allowed and disposed of; (ii) Interim order dated 8th January 2020 is confirmed; (iii) In the event of arrest of applicant no.2 in CR No.178 of 2019 registered with Chembur Police Station, Mumbai, he shall be released on bail on executing PR bond in the sum of Rs.25,000/- with one or more sureties in the like amount.
