The applicant is seeking pre-arrest bail in MECR No. 3 of 2018, registered with Amboli Police Station, Mumbai, for the offence punishable under Sections 420, 417, 464, 465, 467, 468 read with 34 of Indian Penal Code.

The other co-accused, who are brothers of the applicant are already released on regular bail.

The only allegation against the Applicant is that when the complainant paid the amount, the applicant was present, however, no specific role in the matter of commission of offence is alleged against the applicant. Apart from above, the applicant is informed to have already resigned from the Partnership Firm before the alleged incident. 4.

In that view of the matter, ad-interim protection ordered by this Court (Coram : Prakash D. Naik, J.) on 10th January, 2019 stands confirmed.

The Applicant shall not tamper with the evidence or attempt to influence/contact the complainant, witnesses or any person concerned with the case.

6.

The Applicant shall attend Investigating Officer as and when directed.

7.

The application stands disposed of.
