Learned A.P.P, on instructions, states that the trial has commenced and one witness has been examined, till date. She submits that prosecution intends to examine 15-20 more witnesses. Learned A.P.P states that she has no objection, if the trial is expedited. In view of the statement made by the learned A.P.P, learned counsel for the applicant does not press this application and seeks leave to withdraw the same.

Since the applicant is in custody for the last five years and since trial has commenced, it would be appropriate to direct the learned Sessions Judge to dispose of the case as expeditiously as possible and in any event, within nine months from the date of receipt of this order. All parties to cooperate in the conduct of the trial. In the event, the trial does not conclude during the said period, the applicant is granted liberty to file a fresh application.
