This is an application for condonation of delay of about 54 days in filing revision petition challenging the appellate order of acquittal of the respondent No.1 for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881.

Heard both sides. The learned Advocate appearing for the respondent No.1 argued that the applicant is not giving any necessary details about the events as well as dates of events and, therefore, no sufficient case is made out.

(33)APPRNo.62016.doc The application is on affidavit. The delay occasioned is only of 54 days. In view of the Judgment of the Honourable Apex Court in the matter of Collector, Land Acquisition v. Mr.Katiji & Ors. reported in 1987 AIR 1953, for the reasons stated in the application, which is on affidavit, the delay is condoned.

The application is accordingly disposed of.
