The grievance of the Petitioner is that the Petitioner requested for correction in shipping bills omitting declaration of intent and / or mark "No" in the reward scheme item box. The said application was given on 27th July, 2020 and again subsequently on 11th December, 2020, the same is not yet decided. The learned Counsel to buttress his submission relies upon the judgment of the division bench of this Court, in Writ Petition No. 2532 of 2019 dated 02 March, 2021. He submits that the similar facts were subject matter of consideration in the said case. R.V. Patil

The learned Counsel for the Respondents submits that there is a delay in making an application for conversion of the shipping bills. The learned Counsel submits that in view of the circular of the year 2010, the application had to be made within three months. The Petitioner did not apply within three months.

Be that as it may, the applications fled by the Petitioner (Page Nos. 19 and 41) are not decided on merits. The authority may take a decision on the said application preferably within three months. The Petitioner may appear before the authority on 06th April, 2022 and put forth his case. The authority shall consider all the relevant aspects of the matter and take decision upon it on its own merits.

Writ Petitioner is disposed of. No costs.
