Heard Dr. Abhinav Chandrachud, learned Counsel for the petitioners and Ms. Preeti Brahmania, learned counsel for respondent, at length.

By this Petition under Article 227 of the Constitution of India, the petitioners have challenged the judgment and order dated 7.12.2015 passed by the learned Judge, presiding over Court room No.28 of Bombay City Civil Court at Bombay below Exhibit-11 in Summary Suit No.3927/2010. By that order, the learned trial Judge allowed the application made by the 1 / 2

909.wp.289-16.doc respondent/plaintiff under Section 151 of Code of Civil Procedure, 1908 (for short, 'CPC') for recalling the order dated 6.7.2015. By order dated 6.7.2015, the learned trial Judge permitted the petitioners, hereinafter referred to as the 'defendants', to file additional written statement on amended plaint.

After arguing the petition for quite sometime, Dr.Chandrachud, upon taking instructions, seeks permission to withdraw the petition unconditionally. On the motion made by Dr. Chandrachud, the petition is allowed to be withdrawn and is dismissed as withdrawn. Order accordingly.
