After arguing for sometime, learned counsel for the review petitioner on instruction seeks liberty to withdraw this review petition and submits that the pending notice of motion filed by the respondent no.1 before the City Civil Court, Bombay bearing Notice of Motion No.3186 of 2016 for possession and the objection raised by the review petitioner in that notice of motion be heard expeditiously. Statement is accepted.

Review petition is dismissed as withdrawn.

The parties are directed to proceed with the pending notice of motion bearing no. 3186 of 2016 before the City Civil Court, Bombay and shall not seek any unnecessary adjournment before the trial court. 4.

Learned counsel for the parities inform this court that the next date of the hearing of the said notice of motion is 3rd September,2019 and both the parties would proceed with the said notice of motion on the next date and thereafter. Statement is accepted. 5.

The learned trial court shall make an endevour to dispose of the said notice of motion within three months from the date of communication of this order. No order as to costs. 6.

The parties as well as the learned trial judge to act on the authenticated copy of this order.
