CORAM : A.M.BADAR J.

DATED : 24th August 2017.

P.C. :

Criminal Application bearing No.2919 of 1998 is for grant of leave to challenge Judgment and Order of the trial Court acquitting the accused and Criminal Appeal No.626 of 1998 is the substantive Appeal challenging the Judgment and Order of acquittal of accused persons. Though it is seen that leave, as prayed for, in Criminal Application No.2919 of 1998 is not granted, the Registry appears to have registered Criminal Appeal bearing No.626 of 1998.

Gaikwad RD 1/2

(906)APPLNNo.29191998 As Criminal Application bearing No.2919 of 1998 for grant of leave was barred by limitation, the same was accompanied by an Application for condonation of delay, which came to be registered as Criminal Application No.2946 of 1998. The said Application for condonation of delay came to be dismissed for want of prosecution vide order dated 12th April 2016 passed by this Court.

In this view of the matter and as a consequence of order dated 12th April 2016 passed in Criminal Application No.2946 of 1998, Criminal Application bearing No.2919 of 1998, so also, Criminal Appeal bearing No.626 of 1998 stands rejected. (A.M.BADAR J.) Gaikwad RD 2/2
