When this Court expressed its disinclination to grant any relief to the Applicant, taking into consideration the nature and gravity of offence, learned Advocate for the Applicant, on instructions, seeks leave to withdraw the present Application with liberty to file a fresh Application for bail before the trial Court, if the trial of Sessions Case No.771 of 2018 (C.R.No.298 of 2018 registered with Antop Hill Police Station, Mumbai) does not commence within a period of one year from today. by UMESH RAMESH SHINDE Date:

Bail Application No.94 of 2021 is dismissed as withdrawn with aforesaid liberty.

The record indicates that the Applicant is behind the bars since 21/08/2018 i.e. last about 3 years. In view thereof, the learned Additional Sessions Judge seized of Sessions Case No.771 of 2018 is requested to expedite the hearing of the said case and to make an endeavour to conclude the same within a period of one year from the date of receipt of this Order.
