Learned A.P.P, on instructions, states that the trial has commenced and 168 witnesses have been examined till date. He further states that 25-30 more witnesses are to be examined. He submits that the prosecution has no objection, if the trial is expedited. In view of the aforesaid, learned counsel for the applicant does not press this application and seeks leave to withdraw the same. SQ Pathan 1/2

Since the trial has already commenced and 168 witnesses are examined and only 25 to 30 witnesses are yet to be examined, it would be appropriate to direct the learned Judge to decide the case as expeditiously as possible and in any event, within 12 months from the date of receipt of this order. Parties to cooperate in the conduct of the trial.

Application is disposed of accordingly.
