Ms.Anamika Malhotra, AGP for respondent-State. ---- CORAM : K.R.SHRIRAM,J DATE : 3.11.2017 P.C.:- AGP for respondent-State states that respondents are agreeable for referring the matter to arbitration and counsel's instructions are to suggest the name of Mrs.Justice Sujata Manohar, former Judge of Supreme Court of India as the arbitrator on behalf of respondents. Counsel for petitioner states that in the letter invoking arbitration though the petitioner has suggested the name of one Mr.S.L.Jadhao, retired Secretary PWD, Govt. of Maharashtra, petitioner will appoint Shri Justice D.K.Deshmukh, a former Judge of this court as arbitrator of the petitioner. The arbitrator may appoint if they are accepting the reference, the presiding arbitrator in accordance with law.

ARP44.17-38 The fees, administrative expenses, typing charges, photo copying charges, shall be shared equally between the parties and the same will be cost in the arbitral proceedings. The arbitrators, within four weeks of receiving a communication from the advocate for petitioner forwarding a copy of this order shall communicate to petitioner as well as respondent the disclosure as required under Section 11(8) read with section 12(1) of the Arbitration & Conciliation Act 1996.

Petition accordingly disposed.
