The office noting shows that the Appellant has passed away. A copy of the death certificate attested by Assistant PI, Ghodegaon Police Station, mentioning that the Appellant had passed away on 02/06/2016 is produced on record. His heirs have not taken any steps to continue with the Appeal. The fine amount was already deposited and the Respondent No.1 was at liberty to withdraw that amount of Rs.10,000/-. 2.

In this situation, nothing further survives in this Appeal and it stands abated u/s 394 of Cr.P.C.
