IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL PIL (ST) NO. 2 OF 2017 Ketan Tirodkar

...Petitioner

Vs.

State of Maharashtra via Commissioner of Police & Ors.

...Respondents

None for the Petitioner Mr. P.P. Shinde, APP for Respondent State CORAM : B.R.GAVAI & M.S. KARNIK, JJ.

DATED: 14TH AUGUST, 2017 P.C.:

1.

When the matter was listed before this Court on 7 th August 2017 none appeared for the Petitioner. As it is we had directed the Petition to be kept for dismissal today. 2.

Today also when the matter is listed none appears for the Petitioner. The prayer as has been made in the Petition reads thus:

9.A. The Respondent No.1 be directed to gather the data from the agencies wherein the new currency has been seized since 8th November 2016;

2 CRI.PIL(ST).2/2017(24) and present the same in this Hon'ble Court;

B. This Hon'ble Court may be pleased to direct the State to form a Special Investigation Team to register offences under Sections 420, 120(B), 121-A & 378 of the I.P.C; investigate under the provisions of the Cr.P. C and proceed with law:" 3.

From the perusal of prayer clause it would reveal that an omnibus prayer is made in the Petition. No particulars or details of the data which substantiate the apprehension of the Petitioner are found in the Petition. We are therefore of the considered view that merely on the apprehension of an individual, issuance of writ directing Respondent No.1 to gather the data is not possible. The Petition is without any merits hence is dismissed.
