This is an application for anticipatory bail under Section 438 of Cr.P.C. filed by the aforesaid applicant apprehending his arrest in Crime No.347 of 2015 registered with Chaturshrungi Police Station, Pune for the offence punishable under Section 380 of the IPC. 2.
The case of the prosecution in brief is that one Aniket Jadhav had committed theft of gold ornaments belonging to Suvarna Balwadkar, daughter of the complainant Khandu B. Nadhe. The crime registered pursuant to the FIR lodged by said Khandu Nadhe and Aniket was arrested on 8th December, 2015. 3.
The records prima facie reveal that part of the gold
ornaments have been recovered at the instance of said Aniket. The records further reveal that the co-accused Aniket had disclosed to the investigating officer that he had sold the part of the gold ornaments worth Rs.65,000/- to the present applicant, in view of which the name of the applicant was shown as a wanted accused in the remand report.

It may be mentioned here that on 8th January, 2016, the applicant was granted interim bail by imposing conditions. He has already joined investigation. Mrs. Shinde, the learned APP submitted that the presence of the applicant is no longer required for the custodial interrogation. Considering the above facts and circumstances, the applicant is entitled for bail. 5.
Hence the application is allowed on the following terms and conditions.
1. In the event of arrest of the applicant in Crime No.347 of 2015 registered with Chaturshrungi Police Station, Pune, the applicant shall be released on bail bond of Rs.20,000/- (Rupees Twenty Thousand Only) with one local surety in the like amount to the satisfaction of the JMFC, Pune.
2. The applicant shall furnish his permanent and temporary address and telephone number to the investigating officer. The investigating officer shall verify the same before the applicant is released on bail.
