The petitioner No.1 the husband and the respondent No.2 the wife are present with their respective advocates. They jointly request for quashing of FIR No.43/2017 and C.C. No.880/PW/2017 on the file of learned Metropolitan Magistrate, 49th Court, Vikhroli which has arisen out of that FIR. In the Family Court proceedings, Consent Terms are already tendered by the parties on 15/9/2018. Today, respondent No.2 has filed an affidavit accepting Consent Terms and giving no objection for quashing of criminal proceedings.

It is informed that the proceedings for grant of decree of divorce by mutual consent are to be considered by the Family Court on 15/2/2019.

In the situation, accepting joint request we make Rule absolute in terms of prayer clause (a).
