Heard learned Counsel for the parties. Perused the application. Considering the cause made out and the extent of delay, which is of 2 years and 32 days, I am of the opinion that the equities can be balanced by condoning the delay on imposition of costs. 3.

Accordingly, the Civil Application is allowed, subject to the Applicant depositing costs of Rs.500/- in this Court within period of two weeks from today. The Respondent shall be entitled to withdraw the cost.
