By this application under Section 24 of the C.P.C., the applicant/wife seeks order to transfer petition bearing No.P.A.249/2018, filed by respondent/husband before Family Court, Thane u/s 13(1)(ia) of Hindu Marriage Act, 1955 for divorce to Family Court at Pune.

After arguing for some time, learned advocate for respondent/husband submits that he received instructions from his client that they do not have any objection for transferring the matter from Family Court, Chitra Sonawane 1

Thane to Family Court at Pune. He prays that the matter be decided as early as possible.

In view of this fact, both the learned counsel filed Minutes of Order dated 17.6.2019. Same is taken on record and marked 'X' for identification which reads thus:

The applicant and the respondent jointly agree that the petition bearing No.P.A.No.

249/2018 filed by the respondent/husband in the Thane Family Court may be transferred to Pune Family Court and may be heard alongwith the P.A.No.1052/2018 for Restitution of Conjugal Rights filed by the applicant/wife in a time bound period till December 2020.

The applicant and respondent, both the parties will cooperate in hearing of the matter.

By consent of both parties, following order is passed.

a) Petition bearing No.249/2018 filed by respondent/husband before Family Court, Thane u/s 13(1)(ia) of the Hindu Marriage Act, is transferred to the Family Court at Pune and to be heard alongwith P.A.

No.1052/2018 filed by respondent/wife for restitution of conjugal rights, as early as possible.

b) This Court expects that the Family Court, Pune to decide both these matters on or before December 2020, after hearing both sides.

c) Miscellaneous Civil application disposed of accordingly.

d) no order as to costs.

e) Parties to act on authenticated copy of this order.
