In this appeal, challenging conviction, filed by the appellant/accused on 9th May 2017, this court had issued bailable warrant against the appellant/accused. Vide report dated 3rd August 2017, the learned Judge of City Civil and Sessions Court, Mumbai, reported that the Senior Police Inspector, Nehru Nagar Police Station, Mumbai, had reported that the appellant/accused Arson Muniyan Harijan expired. In the meanwhile, vide order dated 14th July 2017, this court had directed issuance of nonavk 1/2

9-APPEAL-658-1997.doc bailable warrant against the appellant/accused. Today, the learned APP has submitted the report of the Senior Police Inspector, Nehru Nagar Police Station, Mumbai, accompanied by Death Certificate issued by the Sub-Registrar, M/E Ward of Municipal Corporation, Mumbai, which shows that appellant Arson Muniyan Harijan died on 3rd April 2006. The report of Senior Police Inspector, Nehru Nagar Police Station, Mumbai, is marked as Exhibit "X" whereas the Death Certificate of appellant/accused Arson Muniyan Harijan is marked as Exhibit "Y" for the purpose of identification.

As the sole appellant/accused died on 3rd April 2006, the appeal stands abated and is consigned to record. (A. M. BADAR, J.) avk 2/2
