The petitioner alleges disobedience of the order dated 20th December, 2018 passed by the learned Judge, Family Court Mumbai at Bandra in Petition No.D-11 of 2018. The said order grant interim custody of the child to the petitioner on every Saturday to Sunday and also grants interim custody/access to the child during Christmas and Diwali vacations.

The said order came to be passed in December, 2018 on an application for interim custody taken out specifcally in view of the circumstances put up before the Court, relying on the emergent circumstances, the access was granted. M.M.Salgaonkar

Mr.Miraaj Oberoi- petitioner, who appears in person, do not dispute that he has already instituted execution proceedings in relation to the order dated 11th December, 2018. Further, the Review Petition to which the reference was made by this Court in the earlier order dated 6th June, 2019 is also now decided and the petitioner is at liberty to take steps to challenge the said order passed on 5th February, 2020 below Exhibit 75 in Petition No.A1351 of 2016. 4.

Reserving the said liberty, since nothing survives in the contempt petition, the same is disposed of.

Needless to state that the Family Court will take appropriate steps in terms of Section 18 of the Family Court Act for execution of its own order.
