The applicants are seeking bail in CR No.I-490 of 2015 dated 6.9.2015 registered with Kashimira Police Station, District-Thane (Rural) under Section 370(3) read with Section 34 of the Indian Penal Code and under Sections 3, 4, 5, 6, and 7 of the Prevention of Immoral Trafficking Act.
It is the prosecution case that, on a specific information received by the Sub-Divisional Police Officer, Mira Road Division, Mira Road the Investigating Agency conducted a raid at Hotel Blue Night (Hotel City Light) after complying with the necessary legal formalities. During the
course of the raid, the police found seven victim women at the said place. It is the prosecution case that the applicants and other accused persons were forcing the said victim women to indulge into the vocation of prostitution and are living on the said income. After completion of the investigation, the police have filed chargesheet.
The record discloses that the applicant No.1 was the Manager of the said Hotel and the applicant No.2 was the conductor of the said hotel. It is the prosecution case that at the time of said raid both the applicants were present at the said hotel. The record further discloses that the statements of the victim women have been recorded by the Investigating Agency. The said women were major in age and in their statements they have no where stated that, the applicants either forced them to indulge into the said vocation or were living on the earning of the said victims.
The learned APP on instructions submitted that there are no antecedents at the discredit of the present applicants. In view of the above, the applicants have made out a case for their release on bail.
Hence, the following order:- (i) The applicants be released on bail in CR No.I-490 of 2015
dated 6.9.2015 registered with Kashimira Police Station, District-Thane (Rural) on their furnishing PR bond of Rs.50,000/- each with one or two solvent local sureties in the like amount.
(ii) After their release from jail, the applicants shall attend the Kashimira Police Station once in a fortnight on Monday between 11.00 a.m. to 1.00 p.m. till conclusion of the trial. (iii) The applicants shall not tamper with the evidence and/or influence the prosecution witnesses.
(iv) The application is allowed in the aforesaid terms. (A.S. GADKARI,J.)
