Heard learned counsel for Parties. Petition in essence seeks the execution of the order passed by the Education Officer, Secondary dated 7 June 2019 addressed to the Respondent-Management. This order is passed under Rule 26(4) of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Rules, 1981. According to the Petitioner, since the Petitioner was declared surplus and absorbed in Shivneri Vidyalaya Gholwad, Taluka Junnar, District Pune and after his absorption regular vacancy is arisen in Respondent No. 1-Sanstha Management.

Since the order is already passed by the Education Officer, Secondary, proceeding on the basis that this order as on today is not verified, modified or set aside, we place responsibility on the Education Officer to ensure implementation of his own order. When an authority passes an order, it is expected to ensure compliance.

The Education Officer will accordingly issue necessary instructions after examining the current position and as to whether the regular vacancy exist in Respondent No. 1-Sanstha Management as of today within a period of 6 weeks from today. 4.

Writ Petition is accordingly disposed of.
