By this application, the applicants seek relaxation of the condition no.(v) imposed by this Court (Coram: G.A. Sanap, J.) vide order dated 6th November 2023 at the time of granting the application for bail, which reads thus :- "(v) Application shall not enter the area of Pune District till completion of the trial, except for the purpose of attending the trial on the given date and that too with prior intimation to Bundgarden Police Station."

Learned Counsel for the applicant has tendered clinical summary of the applicant's father from Chellaram Hospital Diabetes Care & Multispeciality, Pune. The relevant extract of the clinical summary, reads thus :- "LTRI, Type 2 Respiratory failure + Septic Encephalopathy. Chest physician's (Dr. Pankaj Magar) opinion sought and he is advised to continue same Antibiotics, NIV support and ADV - Sputum R & Culture / sensitivity".

The father of the applicant has been advised medicines as well as antibiotics.

Learned APP, on instructions of the Assistant Commissioner of Police submits that the condition may be relaxed in view of the fact that the father of the applicant is undergoing treatment in the said hospital.

Having considered the nature of treatment and the reasons assigned for seeking relaxation of the condition, the applicants are permitted to enter into the Pune District in order to visit their father for a period of four weeks from today.

Needless to say that the applicant shall scrupulously follow rest of the conditions imposed in the order.
