Learned counsel for the applicant submits that application for bail was preferred before the Session Court prior to filing of the chargesheet. It is submitted that the chargesheet was filed on 24.12.2018 and the application was rejected by the Sessions Court on 17.12.2018. It is thus submitted that the applicant be permitted to withdraw this application with liberty to prefer an application for bail before the Sessions Court.
