The applicant seeks pre-arrest bail in Crime No. 360/2019 registered with Trombay Police Station for the offence punishable under Section 307 of the Indian Penal Code. Javed Khan is the injured person. His injury report shows, incise lacerated wound on left chest inflicted by

sharp weapon, another incise lacerated wound on left upper thigh by sharp weapon, injury on left cheek and incise wound on left cheek. All injuries were reported grevious in nature. Prosecution has recorded statements of eye witnesses.

I have perused it. The offence under Section 307 of the Indian Penal Code is punishable with imprisonment which may extend to ten years and /or liable to fine.

In view of the nature of accusations and the evidence collected in the investigation, the application is rejected.

At this juncture, Counsel for the applicant prays that the applicant may be permitted to surrender to police. Accordingly, he is permitted to surrender on 31 st January, 2020 at 3.00 p.m.

It is made clear that observations made hereinabove shall be construed as expression of opinion only for the purpose of refusal to grant bail and the same shall not in any way influence the trial in other proceedings.
