The applicant is apprehending arrest in C.R. No. 761 of 2019 registered with Vijapur Naka Police Station, Dist. Solapur City for offences punishable under Section 420 of Indian Penal Code. The FIR was lodged on 30th November, 2019.

The case of the complainant is that, in the year 2014 the applicant had promised him that he would be provided job. The complainant had paid amount of Rs. 25,000/- by cheque and the balance amount of Rs. 1,75,000/- by cash. The job was not provided. The complainant demanded the amount paid to the applicant. By way of security the applicant gave blank cheque. Cheque was given to the applicant in the year 2014. The cheque was deposited in 2019 which was dishonored.

On perusal of the FIR, it is apparent that the cheque was issued in 2014. The amount parted to the applicant is Rs. 25,000/-. According to the applicant the said amount has been returned to the complainant. It is contented that it was the transaction of hand loan. The cheque has been deposited after 5 years from the date of the transaction. In view of the facts of the case, custodial interrogating of the applicant is not warranted.

Hence, I pass the following order;
O R D E R
i) Anticipatory Bail Application No. 64 of 2020 is allowed;
ii) In the event of arrest of applicant in C.R. No. 761 of 2019 registered with Vijapur Naka Police Station, Dist. Solapur City, the applicant be released on bail on furnishing P. R. Bond in the sum of Rs.25000/-, with one or more sureties in the like amount;
iii) The applicant shall attend Investigating Officer on 15th January, 2020 to 17th January, 2020 between 11.00 a.m. to 2.00 p.m. and thereafter as and when called for till filing of charge-sheet.
