The learned counsel for the applicant, upon instructions, seeks liberty to withdraw the application as the learned Sessions Court has granted bail in favour of the applicant upon an undertaking that he would withdraw the application filed before this Court.

The learned APP submits that in fact, the application before the Sessions Court was not maintainable during the pendency of this application. However, the prosecution is at liberty to take appropriate steps. Application stands dismissed as infructuous.
