This is an application for early hearing of the appeal filed by the State challenging acquittal of the respondent / public servant for offences punishable under the Prevention of Corruption Act.

17-APPA-39-2017.doc The learned advocate appearing for the respondent submitted that though the respondent is in service, the State has issued letter dated 14th November 2014 asking him not to make correspondence regarding his promotion as well as regularization of period of suspension because of pendency of the appeal. The learned advocate, therefore, prays that the appeal be heard expeditiously.

Appeals under the Prevention of Corruption Act filed even prior to 2000 are still pending for hearing. No case for out of turn hearing is made out, particularly when this court is taking up jail appeals in which accused persons are behind bars for more than five years.

The application is, therefore, rejected.
