Learned counsel for the parties state that parties have amicably resolved their dispute and executed the consent terms. Learned counsel for the parties state that their respective clients are present in Court and the learned counsel for the Respondent states that the contents of the consent terms have been explained and the Respondent has also filed an affidavit of Respondent Nos.1 and 5. Learned counsel for the Petitioner states that the consent terms are signed by the authorized signatory of the Petitioner, who is also present in Court. At the joint request, the consent terms are taken on record and marked 'X' for identification.

bsb 2 3.WP1535.16.doc The writ petition is disposed of in terms of the consent terms. The undertakings in the consent terms are accepted. The Respondent has agreed to withdraw the litigation upon receipt of the agreed amount. Liberty to the parties to place copy of these consent terms on record of the Special Civil Suit No.83 of 2014, for appropriate orders and withdrawal of the proceedings. The positive attitude shown by the Petitioner bank and the efforts taken by the learned counsel for the parties are appreciated. (N. M. Jamdar, J.)
