Mahananda Mahadev Bansode v. Child Welfare Project Officer Ekatmik Chilf Welfare Service Project And ORS.
ssk 1 W.P.No.325/2015-4-8-15
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 325 OF 2015 Mahananda Mahadev Bansode ... Petitioner Vs.
Child Welfare Project Officer, Ekatmik Child Welfare Service Project and others ... Respondents Mr. Jaydeep Deo, Advocate for the petitioner. Mr. Anant S. Kulkarni, Advocate for respondents No.1 and 2. Mr. Suhas S. Inamdar, Advocate for respondent No.3. Coram : Smt. R. P. SondurBaldota, J.
Date : 4th August, 2015.
P.C.
1.
The petition challenges refusal of interim relief to the petitioner by Industrial Court, Solapur in Complaint (ULP) No.63 of 2014. The dispute between the petitioner and respondent No.3 is about promotion to the post of Anganwadi Sevika from the post of Anganwadi Madatnis. Respondent No.3 is admittedly better qualified than the petitioner as far as educational qualification is concerned. As regards the work experience, they have almost the identical experience. The earlier Government Resolution prescribed only the minimum educational qualification for the purpose of promotion. However, by the subsequent resolution the Government has directed that a person with the higher educational qualification should be promoted to the post of Anganwadi Sevika. The present petition was filed on 12th January, 2015. Prior to filing of the
ssk 2 W.P.No.325/2015-4-8-15 petition, by the Government Order dated 9th January, 2015 the petitioner has already been demoted. The respondent No.3 was also demoted along with the petitioner but only to be promoted again on temporary basis. In these circumstances, challenge of the petitioner to the impugned order would not survive. Therefore, the same is disposed of accordingly.
2.
Mr. Deo, the learned advocate for the petitioner requests that considering the facts and circumstances of the case, hearing of the proceedings before the Industrial Court be expedited. Considering the issue involved in the proceedings is of promotion to the post of Anganwadi Sevika, it would be proper to expedite the hearing. Therefore, the hearing of Complaint (ULP) No.63 of 2014 is expedited and the Industrial Court, Solapur is directed to dispose the same within a period of 12 months from today. [Smt. R. P.
