The learned counsel for the applicants fairly submits that this case pertains to the year 2005. The charge sheet was filed on 31.10.2007. The case is registered as Sessions Case No.479 of 2012. The applicants were on bail but did not appear before the Court and hence non-bailable warrant was issued. The applicants surrendered before the Court for cancellation of non-bailable warrant and they were taken into custody as they had not appeared before the Court regularly since 2013. As on today, charge is framed and hence it would not be appropriate to consider the application for bail under Section 439 of Cr.P.C. It is in these circumstances, the learned counsel for the applicants fairly prays for expediting the trial. The prayer is granted. Application stands dismissed as withdrawn.

The learned Sessions Court, Thane seized with the Sessions Case No.479 of 2012 is requested to make an endeavour to conclude recording of evidence in Sessions Case No.479 of 2012, as far as possible, within six months from the date of receipt of this order.
