Heard the learned Advocates appearing for the parties and the following Order is passed by consent :

i.

The impugned Order passed by the First Labour Court, Pune dated 8th July, 2013 in Reference (IDA) No. 122 of 2010 is set aside. ii.

The First Labour Court, Pune shall hear Reference (IDA) No. 122 of 2010 afresh and dispose off the same within a period of 12 weeks from the date of this Order.

iii.

The parties shall be allowed to rely on the oral as well as documentary evidence.

iv.

Parties and / or their Advocates shall not seek any adjournment unless absolutely necessary. The First Labour Court, Pune too shall not grant any

v.

All contentions of the parties are kept open. 2.
