The petitioner is not at all clear as to what really is his grievance. However, it appears that the file in Tenancy Appeal no. 16 of 2002 in the court of Sub-Divisional Officer, Thane is misplaced in the office of Sub-Divisional Officer. Therefore, the petitioner applied for permission to reconstruct the file. Learned counsel for the petitioner states that initial permission was granted by the Sub-Divisional Officer later on the Sub-Divisional Officer struck of the permission.

mub p24 wp 1482.16.odt controversy the Sub-Divisional Officer, Thane is directed to decide the petitioners application dated 27/08/2014 seeking leave to re-construct the filed in case the file is really not traceable at Sub-Divisional Officer, Thane. In case the Sub-Divisional Officer, Thane is of the opinion that the matter pertains to jurisdiction of SubDivisional Officer, Kalyan, then, the SubDivisional Officer, Thane may make appropriate orders on this application so that the petitioner is in a position to make the same application before the SubDivisional Officer, Kalyan. This entire exercise may be completed within four weeks from the date of production of authenticated copy of tis order so that the petitioner is not required to run pillar to post in order to get some adjudication in his Tenancy Appeal no. 16 of 2002.

The petitioner is directed to appear before the Sub-Divisional Officer, Thane on 24/02/2016 at 03.00 pm and produce authenticated copy of this order. All concerned to act on the authenticated copy of this order.
