The learned counsel for the applicant submits that the applicant is suffering from 42% disability. It is submitted that in fact the applicant had himself invested about Rs.1,42,000/- in Gold Sukh Trade India Ltd. and he has also been duped by the said Company. However, it appears that the applicant had also asked others to invest in the said Company and hence the applicant is being prosecuted for an offence punishable under Section 420 of Indian Penal Code. 2.
The learned counsel for the applicant, upon instructions, submits that the applicant would surrender before the Judicial Magistrate,
Mhi ABA-36-18.doc First Class, Karmala on or before 25.1.2018 and file an application under Section 437 of Cr.P.C. Hence, the applicant stands protected till 5 p.m. on 25.1.2018.
