1) In pursuance of the Order dated 16th February 2024, Shri.Sachin V. Chikane, I/c. Superintendent Nashik Road Central Prison, Nashik has filed an Affidavit dated 6th March 2024. In para No.11 thereof it is stated that, as per the directions issued by this Court the security amount JYOTI RAJESH MANE of the Petitioner is returned to surety Smt.Varsha Sunil Sonar on 20th by JYOTI RAJESH MANE Date:
2024.03.18 13:20:35 +0530 February 2024. A photocopy of the receipt duly signed by Smt.Sonar is annexed at page No.6 of the said Affidavit.
2) In view thereof, the grievance of the Petitioner regarding nonrefund of the security amount while reporting to the jail, is worked out. 3) As far as quashing of C.R. No.175/2022 registered with Upanagar Police Station Nashik, under Section 224 of I.P.C. is concerned, 1/2
Jyoti 62-wp- 287-2023.doc record indicates that, the Petitioner was released on Covid-19 emergency Parole leave on 9th July 2021 and was directed to report to the jail Authority on a specific date. The Petitioner did not return to the jail authority and therefore the jail administration lodged the said C.R.No.175/2022 under Section 224 of I.P.C. against the Petitioner. The Petitioner was subsequently arrested by Police and brought back to jail after lapse of 44 days. 3.1) In view thereof, we are not inclined tof quash the said FIR registered against the Petitioner.
4) Nothing further survives in the Petition and is accordingly disposed off.
