After hearing the learned Counsel for the applicant, when this Court was not inclined to grant any relief, the learned Counsel on instructions seeks leave to withdraw the present application with liberty to file fresh bail application before the Trial Court, if the trial pertaining to CR No.196 of 2015 registered with Wadala Police Station, Mumbai and now culminated into Sessions Case No.569 of 2015 pending before the Additional Sessions Judge, Mumbai does not commence by 31st December 2016.

Leave and liberty granted.

The application is dismissed as withdrawn.
