This application is filed by the aforesaid applicant for condonation of delay, setting aside the abatement and for bringing on record the legal representatives of the sole appellant. Mr. Pramod Kathane, learned counsel for respondent no.1 who is the sole contesting party has no objection.

In the light of the above statement and in view of the reasons stated in paragraph 5 of the application, delay is condoned. Abatement is set aside and legal representatives of the deceased appellant no.1 are ordered to be brought on record. Cause title to be amended within a period of two weeks.
