This is an application for anticipatory bail in CR No.359 of 2019 registered with Padgha Police Station for offences under Sections 409, 411, 420, 426, 463, 464, 465, 466, 467, 468, 470, 471 r/w 34 of Indian Penal Code.

Learned counsel for applicant and learned APP submit, on instructions from the officer who is present in Court, that parties have amicably settled the dispute. He tendered photocopy of Memorandum of Settlement which indicate that parties have

On perusal of the Memorandum of Settlement it is seen that first the parties will file quashing proceedings in High Court for withdrawal of the case and when the procedure of quashing is complete, the Civil Suit No.75 of 2019 filed in Bhiwandi Court would be withdrawn.

In view of the above, the interim protection granted to the applicant can be confirmed. Hence, I pass following order :

ORDER

(i) Anticipatory Bail Application is allowed and disposed of; (ii) Interim order dated 10-1-2020 is confirmed; (iii) In the event of arrest of applicant in CR No.359 of 2019 registered with Padgha Police Station, the applicant be released on bail on his executing PR bond in the sum of Rs.25,000/- with one or more sureties in the like amount;

(iv) The photocopy of Memorandum of Settlement is taken on record;

(v) Interim Application is disposed of.
