spb/ 29revn438-14.doc The Applicant has been convicted for the offence punishable under section 138 of the Negotiable Instruments Act by the learned Magistrate. His Appeal has been dismissed. This application is for bail and suspension of sentence. Cheque amount is of Rs.35,00,000/-. The Applicant has deposited Rs.4,00,000/- in the Appellate Court. After hearing both the learned counsel, I pass the following order : The Applicant be released on bail in sum of Rs.25,000/- with one solvent surety in the like amount or on deposit of a cash of Rs. 25,000/- in lieu of the surety. Substantive sentences imposed on the Applicant shall remain suspended during the pendency of the revision application.

The applicant shall deposit Rs. 10,00,000/- lakhs in the trial court within eight days from today. If he fails to deposit the said amount of Rs. 10,00,000/-, the bail order passed by this court shall stand revoked and the trial court shall take necessary steps for arrest of the applicant for sending him to prison for undergoing the sentence. Bail Application stands disposed of.

The trial court shall act on an authenticated copy of this order.
