This is an application for Anticipatory Bail in connection with C.R.No.I-292 of 2019, registered with Niphad Police Station, DistrictNashik, for offences punishable under Sections 465, 467, 471, 420, 409 r/w 34 of the Indian Penal Code ('IPC' for short). 2.

The applicant was working as senior clerk since last twenty years in Credit Society namely, Vanasgaon Group Vividh Karyakari Sahakari Vikas Sanstha. It is alleged that, the applicant was instrumental in retaining the amount of Rs.30,38,721/- with him, contrary to the rules during the period from 2018 to 2019. The said amount was allegedly collected from the petrol pump division by cash. The statement of Mr. Madhav, Secretary of vanasgaon Vividh

2 911 ABA-74-2020. Karyakari Sahakari Sansta, indicates that, the said fact was brought to the notice of the applicant by auditor and from time to time the applicant had deposited the said amount. Thus, the amount has been admittedly deposited by the applicant.

Learned APP on instructions submitted that, the suit for recovery of money is pending. Considering the fact that, the amount is deposited, the custodial interrogation of the applicant is not necessary. The applicant can be directed to co-operate with the investigation by attending Investigating Officer.

ORDER

(i) Anticipatory Bail Application No.74 of 2020 is allowed. (ii) In the event of the arrest of the Applicant in connection with C.R.No.I-292 of 2019, registered with Niphad Police Station, District- Nashik, the Applicant be released on bail on his executing P.R bond in the sum of Rs.25,000/- with one or more sureties in the like amount.

(iii) Applicant shall report to the investigating officer on 15th, 16th, and 17th of January 2020 between 11:00 a.m. to 01:00 p.m. and thereafter, as and when called for till filing of charge sheet.
