The Applicants, apprehending arrest, in connection with the investigation of Crime No.31 of 2014 registered with Faraskhana Police Station, Pune, under Section 363, 366, 372, 373, 344, 328 read with Section 34 of the Indian Penal Code and Section 3,4,5,6 and 7 of the Immoral Traffic (Prevention) Act ('PITA Act') are seeking anticipatory bail.

The prosecution case is that a raid conducted at Room No.14 in the premises at Budhwar Peth, Pune, where the Applicants and the co-accused were conducting a brothel and one lady and seven girls were rescued in the operation. The Applicants are the husband and wife. The mother of the Applicant No.2 was arrested and was released on bail somewhere N.S. Kamble page 1 of 3
in the year 2014 itself. The Applicant No.1 is shown to be the registered owner of the premises. Hence, the Applicant No.1 is shown as wanted accused in the charge-sheet filed in the year 2014.

The learned counsel for the Applicants points out that the Applicant No.2 is not shown as an accused. However he also received a call from the Investigating Officer for attendance and they are apprehending arrest. In such circumstances, the following order is passed.
ORDER
(i) In the event of their arrest in connection with investigation of Crime No.31 of 2014 registered with Faraskhana Police Station, Pune the applicants Maili Sonam Tamang and Sonam Manbahadur Tamang shall be released on bail on executing a P.R. Bond in the sum of Rs.25,000/- each with one or two solvent sureties each in the like amount.
(ii) The applicants shall report to the Investigating Officer on 3 and 4 March 2022 between 11.00 am to 1.00 p.m. and as and when called by the investigating officer and shall co-operate with the Investigating Agency.

(iii) The applicants shall not allow the premises to be used for any similar activities.
(iv) The Applicants shall produce their permanent address of Delhi along with proof as also their address at Pune along with proof before the Investigating Officer.
(v) In the event of breach of any of the conditions the bail is liable to be cancelled.
(vi) The Criminal Application is disposed of in the aforesaid terms.
