The petitioner is arraigned as an original accused in CC No.361/SW/2017, filed by the first respondent (original complainant) for the offence punishable under Section 497 of the MAMTA AMAR KALE Indian Penal Code. The present petition has been filed for MAMTA AMAR KALE Date: 2024.03.28 17:27:45 +0530 quashing and setting aside the order of issuance of process against the petitioner.

The learned counsel for the parties jointly placed on record the consent terms and submit that the parties have resolved their disputes amicably. The consent terms are taken on record and marked 'X' for identification.

In view of this, the petition stands allowed in terms of prayer clause (a), which reads thus:- (a) This Hon'ble Court be pleased to quash and set aside the impugned order dated 12/07/2018, passed by the Ld. Metropolitan Magistrate, 17th Court, Borivali, Mumbai, in C.C. No.361/SW/2017 issuing process against the original Accused and further be pleased to quash and set aside proceedings arising out of C.C. No.361/SW/2017 in the interest of justice. R. N. LADDHA, J.
